By-Law Number 76-2023 Being a By-law to regulate and control traffic, prohibit parking, and prohibit depositing of certain materials on Highways within the municipality

Whereas the Municipal Act, 2001, S.O. 2001, c 25, as amended, and the Highway Traffic Act, R.S.O. 1990, c.H.8 as amended, provide that by-laws may be passed by the councils of local municipalities for the regulating and controlling of traffic within their boundaries and for prohibiting the parking, standing or stopping of motor vehicles on the designated highways or the designated parts of highways, and for prohibiting the deposit of snow, or ice or any waste or litter upon a highway and may provide for penalties and enforcement of said by-laws;

And whereas the Council of the Corporation of the Municipality of Bluewater enacted By-law No. 4-2013 on February 4, 2013, to regulate and control traffic, prohibit parking and prohibit depositing of certain materials on Highways within the municipality with subsequent amendments;

And whereas it is deemed expedient to repeal By-law No. 4-2013 and subsequent amendments and replace them with a new by-law to regulate and control traffic, prohibit parking and prohibit depositing of certain materials on Highways within the municipality;

Now therefore, The Council of the Corporation of the Municipality of Bluewater enacts as follows:

Part 1—Administration

1.1. The provisions of this by-law are subject to the provisions of the Highway Traffic Act, R.S.O. 1990, c.H.8 as amended, or re-enacted from time to time and the regulations made thereunder.

The short title of this by-law shall be "Traffic and Parking By-law."

1.2 Schedules

The following schedules are hereby incorporated into and form part of this by-law:

  • Schedule A - Parking prohibitions
  • Schedule B - Fire routes
  • Schedule C - Accessible Parking
  • Schedule D - Part 1 Set Fines
  • Schedule E - Part 2 Set Fines

1.3 Definitions

For the purpose of this by-law:

Authorized Sign means any sign or Highway, curb or sidewalk marking or device, placed or erected anywhere under the authority of Council for the purpose of regulating, warning, or guiding traffic and includes an Official Sign.

Barrier curb means a raised vertical faced curb at the edge of a highway, road or Road Allowance.

Boulevard means the untraveled portion of the Road Allowance.

Corner means the point of intersection of curbs or edges of the Highways.

Crosswalk means that part of a highway at an intersection that is included within the connections of the lateral lines of the sidewalk on opposite sides of the highway measured from the edges of the Highways, or any portion or a Highway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or lines or other markings on the road surface.

Derelict Vehicle means a motor vehicle that: (i) is in a state of advanced disrepair having missing or damaged parts or deteriorated body conditions which render it inoperative, and may include a motor vehicle that had been evidently abandoned by its owner, and left in a place or state of apparent disuse or disinterest by the owner, regardless of whether it is operable or inoperable or licensed or unlicensed for operation, or (ii) a motor vehicle that does not have a current valid number plate affixed thereto as required by the Highway Traffic Act.

Driver "Driver" means any person found in the driver's seat of a vehicle, in possession of the keys or key fob to the vehicle, or otherwise found to be in possession of the vehicle.

Driveway means a vehicular passageway abutting a public thoroughfare or public highway and providing ingress to and/or egress from a property.

Electric Vehicle means any vehicle that is partially or entirely powered by electricity and plugs in to recharge into an Electric Vehicle Charging Station and includes but is not limited to a plug-in electric vehicle and a plug-in hybrid vehicle.

Electric Vehicle Charging Station means any facility, equipment, or infrastructure that supplies electric energy for the recharging of an Electric Vehicle.

Electric Vehicle Parking Space means any parking space designated for the use of Electric Vehicles as indicated by an Authorized Sign.

Fire Route means any and all areas designated as Fire Routes by Schedule "B" to this By-law.

Front Yard means a yard extending across the full width of the property between the front property line and the nearest wall of the main building on the property but does not include a Driveway which complies with all applicable laws and by-laws and/or a parking area which complies with all applicable laws and by-laws, unless the surface of the Driveway or parking area is composed of organic matter.

Garbage means all rejected, abandoned, or discarded materials, containers, and good incidental to the operation of households, farms, business establishments and public places.

Heavy Truck means a vehicle larger than a truck commonly identified as a one-ton pickup truck or a van with maximum one ton cargo capacity, used for the transportation of any material whether animate or inanimate.

Highway means the area of a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, intended for or used by the public for the passage or parking of vehicles.

Intersection means the area embraced within the prolongation or connection of the lateral curb lines of any point where two or more highways meet; or if none, then of the lateral boundary lines of two or more highways that join one another at an angle whether one highway crosses the other.

LRW means Lake Road West. Lake Road West identifies the long and narrow concession of properties situated between the west side of Lake Road, also known as Provincial Highway 21 and Bluewater Highway, and the eastern shore of Lake Huron in the County of Huron.

Manager means the Manager of Development Services or designate.

Minister means the Minister of Transportation.

Ministry means the Ministry of Transportation.

Motor Vehicle includes an automobile, motorcycle, motor-assisted bicycle unless otherwise excluded by the Highway Traffic Act and any other vehicle propelled or driven otherwise than by muscular power but does not include motor vehicles running only upon rails or a motorized snow vehicle, traction engine, farm tractor, self-propelled implement of husbandry or a road-building machine within the meaning of the Highway Traffic Act.

Municipality means The Corporation of the Municipality of Bluewater.

Occupant means the tenant of a property or part thereof.

Officer includes members of the Ontario Provincial Police, a special constable, a peace officer, By-law Enforcement Officer, or any person authorized by the Municipality of Bluewater to enforce the provisions of this By-law.

Official Sign means a sign approved by the Ministry.

One-way street means a Highway upon which vehicular traffic is limited to movement in one direction.

Owner means the registered owner of property or the spouse of that person or the person authorized in writing by the owner to act on behalf of the owner.

Park or parking when prohibited, means the standing of a vehicle whether occupied or not, or for selling or offering goods or produce for sale from a stationary vehicle, except when standing temporarily for the purpose of and while engaged in loading or unloading property or passengers.

Parking Infraction means any unlawful parking, standing, or stopping of a vehicle that constitutes an offence.

Parking Infraction Notice means a notice authorized by the Provincial Offences Act, and placed on any vehicle parked in contravention of this by-law, providing for the payment of the penalty out of court.

Parking Permit means a permit issued by the municipality allowing designated parking in a prescribed area in accordance with the Parking by Permit Policy.

Pedestrian means a person afoot and includes children, persons afoot with mechanical aids or aides, and individuals in wheelchairs or similar devices.

Pedestrian Crossover means any portion of a Highway, designated by By-law, at an Intersection or elsewhere, distinctly indicated for use by pedestrians in crossing the portion of the highway generally travelled by vehicles, by signs on the Highway and lines or other markings on the surface of the Highway as prescribed by the regulations.

Regulations means the regulations made under the Highway Traffic Act.

Road Allowance means all highways that existed on December 31, 2002; all highways established by by-law of a municipality on or after January 1, 2003; all highways transferred to a municipality under the Public Transportation and Highways Improvement Act; all Road Allowances made by the Crown surveyors that are located in municipalities, and all Road Allowances, highways, and lanes shown on a registered plan of subdivision, unless they have been closed, but does not include a provincial highway.

Roundabout means a form of Intersection that accommodates traffic flow in a counterclockwise direction around a central island.

Sidewalk means that portion of a highway, between the curb line or the lateral edge line of a Highway and the adjacent property line, designed and intended for the use of pedestrians, but does not include a pedestrian crossing.

Stop/stopping when prohibited, means the halting of a vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or a traffic control sign or signal.

Stand/standing when prohibited means the halting of a vehicle, whether occupied or not, except for the purpose of and while engaged in the receiving or discharging of passengers.

Time where any expression of time occurs or where any hour or other period is stated, the time referred to shall be Eastern Standard Time, except during a period when Daylight Savings Time is in effect in the municipality, when the time referred to shall be one hour in advance of standard time.

Traffic means lawful vehicular or pedestrian movement on the highway and includes ridden or herded animals, vehicles, and other conveyances either singly or together while using any Highway for the purpose of travel.

U-turn means to turn a vehicle within a Highway to proceed in the opposite direction.

Vehicle includes a motor vehicle, trailer, traction engine, farm tractor, road-building machine and any vehicle drawn, propelled, or driven by any kind of power, including muscular power but does not include a motorized snow vehicle.

Words where any word or expression used in this by-law is not defined herein, reference shall be made to the Highway Traffic Act, the Legislation Act, as amended or re-enacted from time to time or a generally accepted dictionary and the interpretation that best supports the spirit and intent of this by-law shall be adopted.

Part 2 — Parking

2. Method of parking

2.1. No person shall Park a vehicle on any highway except upon the right-hand side of the Highway having regard for the direction in which the vehicle is required to proceed, and when parked on a Highway, with the right front and right rear wheels parallel to and distant respectively not more than 15 cm (6 inches) from the curb, or if none, edge of roadway adjacent to which such vehicle is parked.

2.2. Subsection 2.1 shall not apply to One-way Streets.

2.3. When parking spaces have been established by suitable markings on the road surface, no person shall Park a vehicle except within the space designated by the markings.

2.4. Parallel Parking—when Parking is permitted and angle parking is not required, no person shall park or Stop a vehicle on any highway other than a One-way Street, except on the right side of the highway having regard for the direction in which the vehicle has been proceeding and unless the right front and right rear wheels of the vehicle are parallel to and distant respectively not more than 15 cm (6 inches) from the curb, or if none, edge of highway.

2.5. Angle Parking—where angle Parking is designated by Authorized Sign or pavement markings, no person shall Park a vehicle except at a 45-degree angle form the Highway.

2.6. One-way Streets—where Parking is permitted on a One-way Street, no person shall Park a vehicle facing otherwise than in the direction allowed for travel on that street and with the left front and left rear wheels parallel to and distant respectively not more than 15 cm (6 inches) from the curb, or if none, edge of roadway.

3. Prohibited parking

3.1. Where the schedules to this By-law, as they may be amended from time to time, prohibit parking in any location, at any time or in any manner, and an Authorized Sign giving notice of the prohibition is present, no person shall Park a vehicle in a manner contrary to the authorized sign.

3.2. No person shall Park or Store a vehicle in the following ways:

  1. On a sidewalk
  2. On a Crosswalk or Pedestrian Crossover 
  3. Within the limits of a Roundabout and within 20 metres on any approach Highway to a Roundabout
  4. In a Fire Route
  5. On a bridge or adjacent to the guiderails or cable restraint system for a bridge or, in the absence of guiderails or cable restraint system, 20m from the bridge
  6. Within 3 metres (9.8 feet) of a point on the curb or edge of the Highway directly opposite a fire hydrant
  7. Within 9 metres (29.5 feet) of an Intersection
  8. On any Highway in such position as to obstruct traffic
  9. In such a position as to interfere with the convenience or removal of any vehicle previously parked or standing
  10. In front of the entrance or exit of a school, theatre, auditorium, public hall or other place of assembly during the period when the facility may be occupied by a group of people or for a reasonable time immediately preceding a following such assemblage
  11. In front of the entrance to any hospital
  12. On any Highway in such a position as to interfere with the clearing of snow in any manner
  13. Impeding or obstructing entrance to or exit from a private or public Driveway
  14. On any Highway or Boulevard between the hours of 3:00 a.m. and 6:00 a.m. from November 15th to April 15th each year with the exception of Bayfield Main Highway North from Clan Gregor Square to 70.1 metres (230 feet) north of Catherine Street for businesses with overnight accommodation and/or residential apartments.
  15. Fully parked on a non barrier curbed Boulevard except where paved and signed to permit Parking
  16. On a barrier curbed Boulevard
  17. On a Highway or Boulevard in a manner that restricts the traffic and maintenance requirements of the highway for more than 36 consecutive hours
  18. In any Parking area owned or leased by the municipality for public Parking for any period for more than 36 consecutive hours
  19. In a residential area, a derelict vehicle shall not be parked or stored outdoors
  20. In a Front Yard within a residential area
  21. On Waterworks Road

3.3. At all times, no person shall Park any vehicle such as a van, minivan, SUV, truck of all sizes, tractor trailer unit, motor home, recreational vehicle, farm tractor and apparatus, but not including cars, in the following areas:

  1. Zurich Main Street (Huron County Road 84) on both sides from the Intersection with Goshen Street, east for 30 metres (100 feet)
  2. Zurich Main Street (Huron County Road 84) on both sides from the Intersection with Goshen Street, west for 45 metres (150 feet)

3.4. Sections 3.1–3.3 do not prohibit the proper Parking of bicycles in a bicycle rack erected by the municipality or approved in writing by an authorized representation of the municipality.

3.5. Any vehicle found parked contrary to this by-law may be removed or impounded at the owner's expense.

4. Prohibited stopping

4.1. Where signs prohibiting stopping in accordance with the regulations of the Highway Traffic Act on display, no person shall Stop a vehicle on any highway in a manner contrary to the sign except police, fire department, works department, ambulance, Garbage collection, by-law enforcement and vehicles owned or leased by the Municipality of Bluewater Parking in the course of their duties.

4.2. No person shall Stop a vehicle in any of the following areas when other traffic may experience interference:

  1. On a sidewalk
  2. On a Pedestrian Crossover or Crosswalk, or
  3. Beside another stopped or parked vehicle.

5. Heavy trucks

5.1. No person shall Park a Heavy Truck on any highway in any commercial area for a period longer than required to load or unload cargo.

5.2. No person shall Park a Heavy Truck in any residential area.

6. Limited time parking zones

6.1. Where Authorized Signs are erected and on display, no person shall Park a vehicle on a Highway or part of a Highway described in the Schedules to this by-law for a period longer than the period allowed by the said Schedules.

7. Accessible parking spaces

7.1. Accessible parking spaces are hereby established and described in Schedule 'C' as designated for the exclusive use and convenience of a person with disabilities and the vehicle displays a valid accessible parking permit issued by the Minister.

7.2. Authorized Signs or painted markings bearing the International Symbol for Accessibility shall be used to identify designated public or private parking areas, parking lots or parking facilities, and shall be on display in a manner that the sign or marking is clearly visible to the operator of any vehicle approaching or entering such parking space.

7.3. No person shall Park a vehicle in a designated accessible parking space except when the Parking is for the convenience of a person with a disability who holds a valid accessible parking permit issued by the Minister and the said accessible parking permit is displayed in or on the vehicle in a manner where the entire permit is clearly visible by looking through front windshield of the vehicle.

8. Parking other than on Highways

Public unmetered parking on municipal property is allowed in the following locations until the premises are otherwise required by the municipality:

  1. 14 Mill Avenue, Zurich (Municipal Office)
  2. 10 Goshen Street North, Zurich (Public Library)
  3. 15 East Street, Zurich (Community Complex)
  4. 112 King Street, Hensall (Public Library)
  5. 157 Oxford Street West, Hensall (Community Complex)
  6. Part of Concession 1, Part Lot 21, situated between Wellington Street and the railway, and between King Street and Richmond Street North, Hensall
  7. 18 and 20 Bayfield Main Street North, Bayfield (Public Library)
  8. 38594B Mill Road, Varna (Community Complex)

8.1. No person shall Park a motor vehicle on property owned, leased, or occupied by the municipality or any local board thereof without the consent of the municipality or local board.

8.2. No person shall Park a motor vehicle on private property without the consent of the owner or Occupant of the property.

8.3. In addition to any other penalty that may be imposed, any vehicle parked in contravention of this Section may be removed and impounded at the owner's expense and all costs incurred become a lien against the motor vehicle.

8.4. The Driver or owner of a motor vehicle parked on private property is not liable for a penalty or to have the motor vehicle removed from such property or impounded under this Section, except upon the written complaint of the owner or Occupant of the property given to an Officer appointed by Council to carry out the provision of this By-law.

8.5. Where an owner or Occupant of property has posted signs on the property stating conditions, including prohibition of Parking without consent, a motor vehicle parked on the property contrary to the conditions or prohibition shall be deemed to be parked without consent.

8.6. For the purpose of this section, consent by the Occupant or tenant, or spouse thereof, or person authorized in writing by the Occupant, shall extend only to the control of the portion of land leased or rented by the Occupant or tenant and any parking spaces allotted to the Occupant or tenant under the lease or tenancy agreement.

9. No parking in Electric Vehicle parking space

9.1. No person shall Park a vehicle or any part of a vehicle in an Electric Vehicle Parking space other than an Electric Vehicle.

9.2. No person shall Park a vehicle or any part of a vehicle in an Electric Vehicle Parking space equipped with an Electric Vehicle Charging Station where such vehicle is not connected to that Electric Vehicle Charging Station and in the process of charging.

10. No depositing in road allowance

10.1. No person shall push or blow snow onto the Road Allowance.

10.2. No person shall deposit mud onto the Road Allowance.

10.3. No person shall deposit manure on the Road Allowance.

10.4. No person shall deposit Garbage on the Road Allowance.

11. Keys in parked vehicle

11.1. No person driving or in charge of a motor vehicle shall allow such vehicle to Stand unattended unless the keys are out of the vehicle and the ignition is locked in such a manner that prevents its operation by any person not authorized by the owner, Driver, or person in charge.

12. Designated loading zones

12.1. Where Authorized Signs have been erected and are on display, no person shall Park a motor vehicle between the hours of 8:00 a.m. and 6:00 p.m. in any loading area.

13. Exceptions

13.1. The provisions of this by-law shall not apply to the following vehicles while performing the duties for which they are intended:

  • Fire department vehicles
  • Police department vehicles
  • Ambulances
  • Vehicles owned or operated by the Municipality of Bluewater
  • Emergency vehicles

13.2. Exceptions may be permitted by the Manager in consultation with the Public Works Department.

14. Enforcement and penalties

14.1. An Officer shall enforce the provisions of this by-law.

14.2. In addition to any other penalty provided in this by-law, a Police Officer or By-law Enforcement Officer may cause a motor vehicle that is parked in contravention of this by-law to be removed and taken to be stored at a location determined by a Police Officer or By-law Enforcement Officer.

14.3. Where a motor vehicle is removed and stored pursuant to this by-law, all costs and charges for the removal, care, and storage of the motor vehicle shall be paid by the motor vehicle owner and shall form a lien on the motor vehicle which may be enforced in the same manner as provided for in the Repair and Storage Liens Act.

14.4. An Officer who finds a vehicle parked in contravention of this by-law shall serve the owner or Driver of the vehicle with a Parking Infraction Notice stating:

  1. The plate number and concise description of the vehicle
  2. The alleged offence
  3. The date, time, and place of the alleged offence

14.5. The issuing Officer alleging the offence shall sign the notice and make two (2) copies of the notice indicating that the traffic and parking by-law has been violated, and setting forth in the said notice, the time and place at which voluntary payment of the penalty for the offence may be made.

14.6. The issuing Officer shall deliver one copy to the office of the municipality.

14.7. The issuing Officer shall serve the other copy of the Parking Infraction Notice as follows:

  1. On the owner of the vehicle by affixing the notice to the vehicle in a conspicuous place at the time of the alleged infraction or by delivering it personally to the person having care and control of the vehicle at the time of the alleged infraction, or
  2. On the Driver of the vehicle by delivering the notice to the Driver personally at the time of the alleged infraction.

15. Emergency prohibition

15.1. Notwithstanding any other provisions of this by-law, the Mayor or a person authorized by the Mayor, during emergency or special circumstances, may declare a period of emergency Parking prohibition and by use of signs or other clear directions, may suspend the Parking of vehicles on any Highway or parts thereof. A vehicle parked before the declaration may be deemed to be parked in contravention of this Section, provided that the owner or Driver of the vehicle has been notified of the emergency Parking prohibition and has been given a reasonable opportunity to remove the vehicle.

15.2. No person shall refuse to obey the direction of the Mayor, or authorized person, when performing the duties of Section 15.1.

16. Penalties

16.1. Every person who contravenes any provision in this by-law is guilty of an offence and on conviction is liable to a fine as provided for in the Provincial Offences Act.

16.2. All penalties imposed by a judicial official are recoverable under the provisions of the Provincial Offences Act together with such costs and expenses as are imposed there under.

17. Voluntary payment of penalties

17.1. A person receiving a Parking Infraction Notice may attend or send payment to the location specified on the notice and make voluntary payment within seven (7) days inclusive of Saturday, Sunday, or legal holiday, of the penalty specified on the notice.

17.2. In all cases where a person accused of an infringement of this by-law has not voluntarily paid the penalty imposed within the time set forth for payment, a summons shall be issued to compel that person's attendance before a Justice of the Peace for the County of Huron to answer to said charge.

17.3. Upon payment of the penalty, the person so charged shall be issued a receipt for same and said receipt shall discharge the person guilty of the infraction of the by-law from any further prosecution for such infraction.

17.4. Upon receiving payment at the Municipality of Bluewater administration office of a penalty imposed by a traffic offence, the Officer shall be notified of the payment, by whom it was made, and at what time it was made.

17.5. All penalties collected under this by-law shall be part of the general revenue of the Municipality of Bluewater.

18. Commencement and transition

18.1. This by-law shall come into force and effect on October 1, 2023.

18.2. The following by-laws are hereby repealed on the day this by-law comes into force and effect:

By-law 48-2023 and 62-2023

18.3. The provisions of this by-law affecting traffic on a highway designated as a connecting link pursuant to the Public Transportation and Highway Improvement Act shall not become effective until approved by the Ministry of Transportation.

  4. Adjacent to the Hensall Community Complex on Oxford Street on the south side from Brock Street, west for 80 metres (262.5 feet)
  5. Adjacent to the Hensall Community Complex on Oxford Street on the north side from Brock Street, west for 46 metres (151 feet)
  6. Adjacent to the Bayfield Community Complex and Agriculture Park entrance on Fry Street, on the southwest side, from Jane Street, south for 15 metres (50 feet) to the fence
  7. Zurich Community Complex property from the northwest Corner, east for 30 metres (98 feet)
  8. Along the west wall of the Hensall Public Library building on municipal properties known as 108 and 112 King Street, from King Street north for 40 metres (131.2 feet)
